Applicant apprehends arrest in connection with Crime No. 026/2023 registered with Shirur Anantpal Police Station, Dist. Latur for the offences punishable under Sections 302, 307, 324, 323, 504 and 34 of Indian Penal Code and Sections 3(1)/181, 130(1)/177 of Motor Vehicles Act.

First Information Report indicates that some meeting took place between the parties on 1st February, 2023 at about 2.00 pm in the agricultural feld wherein discussion took place with regard to the dispute over way. Thereafter some incident occurred wherein uncle of the informant was given dash by the motorcycle. It is alleged

- 2 - aba1290.23.odt that co-accused threw stone at paternal uncle of the informant due to which he sustained head injury. As far as present applicant is concerned, it is alleged in the First Information Report that he threatened the informant.

Perusal of First Information Report as well as chargesheet indicate that except for the allegation against present applicant that he threatened the informant at the spot, no other overt act is said to have been done by him. He is not responsible for causing any injury to any person in the said incident. In view of this, application is allowed in terms of the interim order.
