This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.64/1999, registered at Kopargaon City Police Station, District Ahmednagar, for the offences punishable under Sections 395, 120(B), 427, 420 of the Indian Penal Code and under Sections 4 and 25 of the Arms Act.

Heard. Perused the First Information Report (FIR) and related papers.

The offence dates back to the year 1999. The applicant was allegedly absconding. According to the learned Advocate for the applicant, the applicant was serving as a 'Waiter' with a hotel at Babhaleshwar. Supplementary charge-sheet has been filed against the applicant.

After having gone through the FIR dated 22.02.1999 and the role attributed to the applicant herein, this Court is inclined to grant him bail. Hence, following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.64/1999, registered at Kopargaon City Police Station, District Ahmednagar, for the offences punishable under Sections 395, 120(B), 427, 420 of the Indian Penal Code and under Sections 4 and 25 of the Arms Act, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.

(iii)The applicant shall not tamper with the prosecution evidence.
