This is an application for withdrawal of the amount of compensation deposited by the insurance company - respondent no.1 in this Court.

According to the applicant, the applicant sustained ten per cent permanent disability in the motor vehicle accident and the amount of compensation granted by the learned Tribunal is just and proper. Therefore, the amount deposited by the insurance company can be paid to the applicant.

Learned counsel appearing for the insurance company has opposed the withdrawal of the amount of compensation.

I have gone through the reasons recorded by the learned Tribunal while awarding the amount of compensation.

In view of above, the amount deposited by the insurance company can be permitted to be withdrawn by the applicant, on an undertaking that in case adverse orders are passed against him in the appeal, then he will re-deposit the said amount in this court within a period of 12 weeks from the date of the order passed by this Court in appeal.

Hence, in view of above, the applicant is permitted to withdraw entire amount of compensation together with interest deposited in this Court by respondent no.1.

Civil Application is disposed of.
