The applicant / accused by this application is praying for relaxation of Condition No. (iii) in order dated 16th July 2015, passed by this Court in Criminal Application No. 2087 of 2015, granting prearrest bail to the applicant. The condition is to the effect that the applicant should attend Kallamb Police Station once in a week, preferably on every Tuesday in between 02.00 p.m. to 03.00 p.m., till the charge-sheet is filed.

It is reported that the applicant, who is Avval Karkun, is now transferred from Tahsil office, Kallamb, to the office of Collector, Osmanabad, and therefore he is unable to fulfill this condition at the cost of his public duty. The learned Counsel for the applicant submitted that as yet no charge-sheet is filed.

The order granting pre-arrest bail to the applicant shows that the applicant had limited role in the crime in question. He was to put forth the prepared bills before the Tahsildar.

In this view of the matter, Condition No. (iii) of the order dated 16th July 2015 is modified and the applicant henceforth to attend the concerned Investigating Officer as and when reasonably called by him.

The Application stands disposed of in the aforesaid terms.
