We have heard Mr. Tribhuwan, learned counsel for the petitioner. The learned counsel submits that respondent No. 1 be directed to grant permission to fill in the posts which are vacant with respondent Nos. 2 and 3.

The affidavit is filed by the respondent Nos. 2 and 3 to the effect that the process has commenced for filling in the post by making an appointment on compassionate ground.

Paragraph No. 9 of the affidavit reads thus : "I say that, answering respondents would accommodate and

2 84-WP9988-19.odt appoint petitioner as per Seniority/Priority List considering availability of posts and policy of the government. Answering respondents cannot directly give Appointment Order to petitioner by superseding and overlooking other candidates, who are placed before petitioner in Seniority/Waiting List."

It is submitted by the learned A.G.P. on instructions that the petitioner is at serial no. 20 of the wait list of the candidates to be appointed on compassionate ground. As and when the process would be commenced, the petitioner would naturally be considered as per the seniority and considering all the relevant aspects of the matter. 5.

In view of the affidavit filed, the writ petition is disposed of. No costs.
