Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant seeks bail in C.R.No.0199 of 2023 registered with Waluj Police Station, Taluka Gangapur, District Aurangabad, for the offences punishable under Sections 307, 427, 504 read with Section 34 of the Indian Penal Code.

The injury report of the injured reveals that he has not suffered serious injuries except the trauma. The nature of the injuries were simple. The weapons allegedly used in the crime by the accused were seized. The material investigation has been completed against the applicant. There were no antecedents to his discredit. The investigation about the other co-accused is in

952-BA-1347-23.odt progress. Considering the nature of the quarrel and the injuries, the Court is of the opinion that it would be improper to keep him behind bars. Hence, the order:- i) The application is allowed.

ii) Applicant Shaikh Anis Shaikh Madan be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall never visit the hotel of the injured till conclusion of the trial.

(c) He shall attend the police station as and when called on a written notice by the Investigating Officer till filing the chargesheet ( S. G. MEHARE ) JUDGE rrd
