This application is by wife seeking transfer of proceedings of Hindu Marriage Petition No.19/2011 pending on the file of learned Civil Judge, Senior Division at Shrirampur to the Court of learned Civil Judge, Senior Division at Beed.

The inconvenience and hardship of the wife are the grounds which are pressed into.

The said contentions are objected by the learned Counsel for
the respondent on the ground that the applicant is financially sound and is having her vehicle to travel. As such prayed for dismissal of the application.

Keeping in mind the law laid down by the Apex Court in the matter of Sumita Singh Vs. Kumar Sanjay & anr., reported in AIR 2002 SC 396, it will be appropriate, in my opinion to consider the hardship of the applicant.

In view thereof, the present application stands allowed in terms of prayer clause (B), which reads thus :
"B.
The Hindu Marriage Petition bearing No.19/2011 pending before the learned Civil Judge, Senior Division at Shrirampur may kindly be transferred to the learned Civil Judge Senior Division Court at Beed."
