PER COURT :- 1) Heard. So far as relief claimed in prayer clause (C) is concerned, the learned Counsel appearing for the petitioner has invited our attention to inter se communication dated 17th February, 2009 between Education officer (Primary) Zilla Parishad, Nanded and President/Secretary of Respondent No.4 - institution and submitted that since the petitioner was placed in pay-scale of Rs. 5,500-9000, which is the pay scale as admissible to the post of Head Master and said pay scale was approved by the Education officer, the salary of the petitioner should have been calculated keeping in view of the aforesaid communication and approval granted by the Education officer. In that view of the matter, we direct the respondents and in particular Respondent Nos. 2 and 3 to pay the arrears/salaries of the petitioner keeping in view of the approval granted by the Education officer and if there are BDV

BENCH AT AURANGABAD any subsequent modification/fresh orders, governing the service of the petitioner, and ensure that the amount of salary /arrears is disbursed to the petitioner, as expeditiously as possible and preferably within a period of eight weeks from today.
