Learned advocate for the respondent/University submits that the University has filed reply on merits, he has now received instructions from the University stating that the order under challenge would be recalled and the matter regarding grant of affiliation pursuant to the petitioner's request would be taken before the academic council in the next meeting.

Learned advocate for the petitioner in view of such stand being taken on behalf of respondent/University would submit that though the petitioner has been questioning the decision purportedly taken by the Deputy Registrar of Education Department and few other prayers are made, the petitioner is interested only in prayer clause 'A' and 'C' for the time being.

Since whatever is being claimed by way of prayer clause 'A' and 'C' is being accepted by the University in view of the statement being made across the bar on its instructions by its learned advocate, we accept that stand of University as an undertaking to the Court and dispose of the petition permitting it to recall the order under challenge dated 02.08.2024 and undertake the process through the academic council.

Pending civil application for intervention is disposed of. 6.

All the issues are kept open.
