PER COURT :- 1) Heard. Perused the order passed by learned Single Judge in Writ Petition No.1456 of 2010 decided on 28.4.2010. 2) The writ petition was directed against the order passed by the Regional Labour Commissioner, Nagpur, directing the petitioner/appellant to deposit difference amount of wages amounting to Rs.34,467=66 ps. together with compensation equal to five times the difference in wages quantified at Rs.1,72,338=30 ps. It is not a matter of dispute that the appellant has not paid the minimum wages prescribed under the Minimum Wages Act and as such, he is liable to pay the difference in wages; penalty and compensation. So far as amount of compensation is concerned, the Regional Commissioner has taken a lenient view and directed the appellant to deposit the compensation at a sum equal to five times the difference in wages. A belated writ petition presented in the year 2010 has been dismissed by the learned Single Judge on account of delay as well as on the ground that considering the merits of the contentions, no interference was required. We do not find any reason to interfere with the order passed by the learned Single Judge. There is no error of law apparent on the face of record in the order passed by the Regional Commissioner, directing the petitioner to deposit the difference in wages; penalty and compensation. The Appeal is devoid of substance and stands rejected.
