DATE : SEPTEMBER 20, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.175 of 2022 registered with Bhoom Police Station, Dist.Osmanabad.

Heard learned counsel appearing for the parties. 3.

The applicant is alleged to have slapped the Bailiff of the Court, when he had been to the applicant's house for execution of warrant of seizure of household articles. Based on the FIR lodged by the concerned Bailiff, crime came to be registered against the applicant and the co-accused. The applicant is in jail for over one month.

Learned counsel for the applicant states that the applicant repents over the incident.

Considering the nature of the offence, the application deserves to be allowed. Hence, the following order:- (i) The application is allowed.

(ii) The applicant be released in connection with Crime No.175 of 2022 registered with Bhoom Police Station, Dist.Osmanabad, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence.
