Leave to add/amend the prayer clause for transfer of the petition bearing No.D-14 of 2020 fled by the Respondenthusband for custody of the child, pending before the Family Court at Aurangabad to Family Court at Pune.
Heard fnally at the stage of admission by consent of learned Counsel for respective parties.
The learned Counsel for the respondent-husband, on instructions, submits that the respondent-husband has no objection if both the proceedings, as detailed in the prayer
{2} clause, are transferred from Family Court, Aurangabad to Family Court, Pune. The learned Counsel submits that petition bearing No.A-516 of 2015 fled by the respondent-husband seeking decree of divorce is pending since long and even though the petition for custody of the child has been fled recently, however, after transfer of both the matters, the Family Court may be directed to dispose of both the matters, as expeditiously as possible in a time bound manner.
The learned Counsel for the petitioner wife has no objection if certain directions are given to the Family Court, Pujne for expeditious disposal of both the matters after transfer of these matters from Family Court, Aurangabad to Family Court, Pune.
In view of the above, I pass the following order: (i) Misc. Civil Application is allowed in terms of prayer clause "B".
(ii) On transfer of both the proceedings, as detailed in prayer clause "B", from Family Court, Aurangabad to Family Court, Pune, the learned Judge of the Family Court, Pune is
{3} hereby directed to dispose of both the matters as expeditiously as possible, preferably within a period of six months from the date of receipt of this order.
(iii) Parties shall cooperate with the Family Court, Pune for expeditious disposal of the matters, as directed above. (V.K.JADHAV) JUDGE adb
