Advocate for the petitioners: Mr. K.N. Shermale Advocate for respondent Nos. 1-a to 1-P: Mr. D.R. Adhav .....

CORAM : V. K. JADHAV, J.

DATED : 17th JANUARY, 2020 PER COURT:- 1.

This writ petition was heard by this court on 06.11.2019 and after hearing both sides at length it was reserved for pronouncement of judgment. However, in the meanwhile, on 6.1.2020, the learned counsel for the petitioners circulated the matter on the ground that the matter is amicably settled between the parties. By order dated 6.1.2020 the Registrar (Judicial) of this court was directed to verify the terms of compromise and submit a report till the next date of hearing. The matter was adjourned to today.

2.

Learned counsel for the parties submit that the parties have arrived at amicable settlement and they have worked out the terms of compromise. As directed by this Court on 6.1.2020, the terms of the compromise are verified through the Registrar (Judicial) of this Court. The said compromise is taken on record and marked "X" for

wp9285.14 -2identification. In terms of the said compromise and also in terms of the provisions of Maharashtra Tenancy and Agricultural Lands Act 1956 the parties are required to approach the competent authority to initiate the appropriate proceeding for surrender of tenancy and it is for that authority under the relevant provisions of Maharashtra Tenancy and Agricultural Lands Act to consider the same on its own merits. However, this writ petition stands disposed of since the petitioners are not willing to prosecute this writ petition for the reason that the parties have arrived at amicable settlement. 3.

The writ petition is accordingly disposed of. ( V. K. JADHAV, J.) rlj/
