Heard the learned counsel for the applicant and learned APP for the respondent-State.

The applicant mother-in-law of the deceased seeks bail in Crime No.271 of 2024, registered with Sangamner Taluka Police Station, District Ahmednagar, for the offences punishable under Sections 302, 498-A, 323, 504, 506 read with Section 34 of the IPC.

The prosecution case in brief was that on the day of the incident, the deceased and the applicant had a quarrel over washing clothes. The victim had left the home. When she was leaving home, the close relatives of the applicant brought her back to home with her husband. However, suddenly, the
incident happened. The Post Mortem report shows the strangulation marks and head injury. The weapon used to cause the injury has been recovered from the husband. Except the allegations of ill-treatment by this applicant for dowry demand, there was no other material. However, admittedly she was present in the house when the incident happened. Father-in-law had also met the deceased in the mid-way when she was leaving home. However, he was not arraigned as an accused. The incident happened in the evening. She was strangulated to the window and assaulted on head. Except the head injury and strangulation, there were no other injury on her person. At the most, it could be said that the applicant was present there. But about her role the evidence is balancing. Therefore, she would be benefited. Hence, she deserves bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant SUBHADRA NIVRUTTI WALVE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :
(a) The applicant should not tamper with the prosecution witnesses.
(b) She should attend the trial on each and every date.
