PER COURT :- Learned Advocate for the petitioner submits on instructions that though the promotion of the respondent from technician to higher technician would result in the reduction of his service tenure by advancing his retirement age by two years, all employees of the petitioner were intimated to go through the service Rules applicable, at the time of joining duties. However, it is fairly stated, on instructions, that the respondent has not specifically intimated him that his promotion as a Sr. Technician would result in advancing his retirement by two years as his retirement age would be reduced from 60 years to 58 years.

Since I find that the law prescribed under Section 9A of the Industrial Disputes Act, 1947 read with the Fourth Schedule is likely to apply in this case, the learned counsel prays for a short accommodation akl/d
