Learned counsel for the applicant submits that, though the applicant has taken efforts to procure death certificate, however, the Municipal Corporation, Nashik informed to the applicant that entry in death extract is not recorded about respondent No.1E. Consequently, death certificate is not produced alongwith present application. Learned counsel submits that, though proposed L.Rs. Of respondent 1E are served, none appears for him.

Learned counsel also submits that, inadvertently aaa/-

WP 10259.2017.odt the name of respondent No.1A is shown as no more alive, however, learned counsel is already appearing for respondent no.1A.

Considering the above, application is allowed in terms of prayer clause A, B and C.
