Applicant seeks protection of anticipatory bail by virtue of registration of crime no. 0461 of 2025 registered at Ahmedpur Police Station, District Latur for offence under Section 108 of BNS. 2.

Learned counsel pointed out that there is false implication. That, there are allegations that informant's brother Ankush allegedly consumed poison on 21.03.2025 for the best reasons known to him. That, report of such incidence is lodged on 01.07.2025 and as such, it is delayed and afterthought complaint. That, applicant, who is a lady, has no concern. That, wife of deceased, namely, Nirmala was going for work at applicant Anita's place, and deceased was insisting his wife for not to work there saying that applicant was not a good

-2woman, and on this count, there were quarrels between deceased and his wife Nirmala. That, due to internal family matter between deceased and his wife, occurrence seems to have taken place. There is no evidence to suggest abetment or instigation. For all above reasons, according to learned counsel, custody is not necessary, when applicant is ready to cooperate with the investigation. Hence, relief is urged for. Learned counsel further pointed out that, wife of deceased, i.e. Nirmala, is already beneficiary of regular bail by this Court by order dated 08.08.2025.

Learned APP opposed by taking this Court through the FIR and would submit that, applicant, apart from having criminal antecedents, has allegedly issued threats, of which NC is also reported. Because of above pressure, deceased committed suicide. Applicant is named and for effective investigation, he prays to reject the application. 4.

Perused the FIR dated 01.07.2025 at the instance of Sayas Baburao Jadhav, who seems to be younger brother of deceased Ankush. He reported that, deceased was working as labour at Balsadan and resided at Ayodhyanagar with his family. It is reported that, wife of his brother (deceased) used to work at applicant's place. Deceased used to warn her about present applicant to be not a good

-3lady and to not to go there, however, as wife of deceased did not pay attention, it is alleged that, there used to be quarrels between husband and wife. It is further reported that there was quarrel on 18.03.2025 between husband and wife. It is further informed that, informant received phone call from his brother Ankush informing about his wife Nirmala and present applicant abusing and beating him. It is reported that, present applicant questioned informant's brother for suspecting her character and leveling false allegations, and gave him slaps and also allegedly threatened to leave Ahmedpur and that he would not be spared. His brother lodged report at police station. That, on 21.03.2025, informant learnt that his brother Ankush had consumed poison and was admitted in the hospital. While undergoing treatment, he expired on the midnight of 22.03.2025. Hence the above report.

Thus, what is discerned from above discussion is that, deceased warned his wife Nirmala for severing relations with applicant Anita, but she did not listen. On 18.03.2025, some incidence had taken place near the court premises wherein present applicant is named for questioning, abusing and slapping deceased and occurrence was reported to police. However, deceased seems to have consumed poison on 21.03.2025, i.e. after 3 to 4 days. There is nothing in

-4immediate proximity suggesting any incidence amounting to inducement, abetment, instigation or creation of circumstances which compelled deceased to take extreme step of consuming poison. Applicant is a lady and she undertakes to cooperate with the investigation. Hence, the following order :

ORDER

I.

The application is allowed.

II.

In the event of arrest of the applicant in connection with crime no. 0461 of 2025 registered at Ahmedpur Police Station, District Latur for offence under Section 108 of BNS, she shall be released on executing P.B. and S.B. of Rs.15,000/- with one surety in the like amount.

III.

The applicant shall attend the concerned Police Station as and when called on prior notice by the Investigating Officer till filing of the charge sheet and co-operate in the investigation. [ABHAY S. WAGHWASE, J.] vre
