Besides the allegation of doing illegal business of gutkha, it has been alleged in the FIR that one of the co-accused asked the persons present on the spot of incident to catch hold the complainant, who is a police sepoy and driver on the police vehicle, and he tried to run the Bolero pickup vehicle over him and fled away with the said vehicle. As far as the present applicants are concerned, mere allegations have been levelled against them that

37-ABA-1203-2022 -2they intercepted the public servant and pushed and pulled him. They were present on the spot of the incident. The reason best known to the police why they did not arrest them immediately after the incident. Considering the allegations levelled against the applicants, they have a good case for anticipatory bail. Hence, the following order:

ORDER

I.

The application is allowed.

II.

The interim protection granted by order dated 12.09.2022 is confirmed on the same terms and conditions.
