Heard learned counsel for the Applicants and learned APP for the State.

The Applicants seek bail in Crime No. 0272/2024 registered with Paithan Police Station, District Aurangabad, for the offences punishable under Sections 3(5), 309(6) and 311 of the Bhartiya Nyaya Sanhita.

Perused the First Information Report. It reveals that the Applicants were with the co-accused. The another co-accused restrained the injured and beat him by a wooden log. They snatched

- 2 - ba1460.24.odt his mobile handset and currency notes. So far as role of the Applicants is concerned, bare allegations of beating the complainant with kicks and blows and abusing him were made. Apparently, they did not use any weapon. Nothing is to be recovered from them. No purpose would be served in keeping them behind the bar. Hence, they deserve bail. Hence the following order :-

ORDER

(i) Bail Application is allowed.

(ii) Applicants Abhilesh s/o Suresh Ghodke and Yash s/o Suresh Ghodke be released on furnishing P.B. and S.B. of Rs. 50,000/- each (Rs. Fifty Thousand only) with one solvent surety each of like amount, in connection with Crime No.0272/2024 for the above offences, on the conditions that they shall attend the police station as and when called by the Investigating Officer, till filing of the charge-sheet.
