Applicant/accused in Crime No. 80/2016 registered at Azadnagar police station, Dhule for the offences punishable U/ss 193,200,467,468,471,474 read with 34 of the Indian Penal Code by this application is seeking pre-arrest bail.

Heard learned counsel for the applicant and learned A.P.P. Perused the record made available. The crime in question is registered on the basis of the report lodged by
2 Cr.Apln. 4542.2016 the officials of Vigilance Cell, Dhule. The averments against present applicant are to the effect that she used forged caste certificate issued by the Sub Divisional Officer and relied on the affidavit of present applicant in order to show that her near relative has been granted validity certificate. According to the informant, applicant had also relied on forged property card in order to substantiate her claim as Scheduled Tribe [Rajput Bhamta].

It is seen that the Vigilence cell has already conducted necessary investigation to conclude that the Tribe certificate and property card submitted by the applicant for getting validity certificate are forged documents. Similarly, necessary enquiry is already held in order to conclude that Ratan Narayan Patil is not relative of the applicant. In other words, all necessary evidence in this offence based on documentary evidence is already collected by the Vigilence cell.

The applicant is reported to be running pregnancy of 7 months duration. Considering the fact that the necessary investigation is already over and the documentary evidence is already collected as well as the fact that the applicant is a woman running pregnancy, her custodial interrogation is not warranted. Hence, the following order.
(i) The application is allowed.
(ii) In the event of her arrest in Crime No.
3 Cr.Apln. 4542.2016 80/2016 registered at Azadnagar police station, Dhule for the offences punishable U/ss 193,200,467,468,471,474 read with 34 of the Indian Penal Code, applicant Priyanka d/o Sukdeo Sonawane @ Priyanka w/o Lalitsing Patil be released on bail on executing P.R. Bond of ` 10,000/- [Rupees Ten Thousand] and on furnishing surety in the like amount. (iii) As a condition of this Order, the applicant shall not extend any threat, inducement or promise to the persons acquainted with the facts of the accusation so as to dissuade them from disclosing the same either to the police or the Court.
(iv) The applicant shall not tamper the evidence of the prosecution.
(v) The applicant to attend concerned police station on 04/09/2016 in between 11.00 a.m. and 12.00 noon and she should co-operate the Investigating Officer in the investigation of the crime in question.
