The present applicant seeks leave to amend.

We have heard Mr Soman, the learned counsel for the applicant and Mr Tope, the learned counsel for non-applicant. 3.

Under the present application, the amendment is sought to the extent of the area of the land of which notice under section 127 of the Maharashtra Regional Town Planning Act, was issued. 4.

Even otherwise, the non-applicant will have every opportunity to controvert the averments sought to be introduced by way of amendment.

For the reasons stated in the application, the civil application is allowed in terms of prayer clause (B).
