The Applicant has taken out this application seeking order to condone the delay, set aside the order of abatement and permission to bring the legal representatives of deceased Appellant as well as Respondent on record.

In view of the facts pleaded in the application and further taken note of the fact that the parties have settled the matter and appeal is to be disposed of in terms of the settlement arrived at in Regular Civil Appeal No.43 of 2014 before the learned District Judge-1, Kandhar, District Nanded, I am inclined to allow the application.
