Heard learned Advocate for the applicant and learned Advocate for the respondent.

Learned Advocate for the respondent has strenuously opposed the application stating that the reasons assigned in the application are not genuine and no case is made out by the applicant for condonation of delay.

Taking into consideration the fact that an ex-parte decree is passed by Family Court, for the reasons stated in the application, the application is allowed. Delay is condoned.
