Heard learned counsel for the applicant. None present for the respondent though served.

Learned counsel for the applicant submits that the applicant has paid entire cheque amount which is subject matter before the trial court, through R.T.G.S. to the respondent i.e. original complainant. Learned counsel has tendered an affidavit of the applicant before this court, which is taken on record. Learned counsel for the applicant, on instructions, submits that the applicant be permitted to withdraw this application with liberty to file appropriate proceeding before the trial court mentioning that the applicant has paid entire cheque amount to the complainant.

Considering the submissions of the learned counsel for the applicant, the application is allowed to be withdrawn and disposed of with liberty as prayed for.
