Heard learned Counsel for the parties.

The learned Counsel for the applicant (original respondent) submits that the amount deposited by the respondent (original applicant) may be allowed to be withdrawn by the applicant, subject to his furnishing solvent surety.

For the reasons stated in the Civil Application, it is allowed. The amount deposited by the respondent in this Court be paid to the applicant (original respondent) on his furnishing solvent surety of the like amount.

The Civil Application stands disposed of in above terms. 5.

Post the matter for admission on 13th November 2017 by way of last chance.
