The Civil Application is filed for recalling the order dated 22 July 2016 passed in the writ petition. The order dated 22 July 2016, which sought to be recalled records that the petitioner has not taken steps as against respondent No.3 and the petition was dismissed as against respondent No.3.

By this petition, the petitioner has challenged the inquiry report of an inquiry held against the petitioner for misappropriation

Madkar 2 C.A. No. 11558 of 2016 and fixing of liability of S 1,86,423. The petition was filed on 28 February 2014. The Civil Application, which is filed for recalling the order as against respondent No.3 is also pending since the year 2016. There is no interim relief in this petition operating right from the date it was filed. That would mean there is no interim relief /stay to the impugned orders.

The Civil Application as against dismissal of the petition against respondent No.3 is allowed. The writ petition is restored to the file and it be placed on board on 15 January 2019. 4.

It is again clarified that there is no interim relief operating in this petition at present and the authorities will take note of it. N.M. Jamdar, J.
