We have heard the learned advocate for the petitioner. The learned advocate submits that, the authorities are not initiating action against the illegal construction of the respondents. 2.

The petitioner alleges encroachment on his property i. e. private land. The dispute would be about the boundaries. It would not be possible to decide the issue of alleged encroachment of private parties in the writ jurisdiction.

The petitioner may take up appropriate proceedings before the Civil Court or any other forum as may be permissible under law. In that event all contentions are kept open. The writ petition is disposed of. No costs.
