The learned counsel for the petitioner, on instruction, seeks leave of this court to withdraw the present writ petition. However, he submits that the interim order operating during the pendency of the proceedings before the SDO may be continued for the period of two weeks as the petitioner would intend to file civil suit seeking his remedy before the Civil Court. 2.

Considering the prayers made, the writ petition is dismissed as withdrawn. The interim order operating during the pendency of the proceedings before the SDO to continue to operate for the period of two weeks from today.

It is made clear that the interim order is continued for the two weeks so as to enable the petitioner to give opportunity to file civil suit. If such suit is filed, the trial Court would decide it on it's own merits independently without influenced by the orders passed by the authority constituted under Mamlatdars' Courts Act or by this Court.
