BENCH AT AURANGABAD.

36 WRIT PETITION NO. 12523 OF 2015 MEERABAI JALINDAR JADHAV AND OTHERS

VERSUS

ASHOK RAOJI JADHAV AND ANOTHERS ...

Advocate for Petitioners :Mr. Vinod Prakash Patil ...

CORAM : R. M. BORDE, J.

Date: March 07, 2016 ...

PER COURT :- The challenge raised in the instant petition is in respect of the mutation entries, directed to be recorded by the revenue authorities and the decision by the appellate forum. It is not a matter of dispute that, there is a Civil litigation pending between the parties, at appellate stage. It is well established principle that, the mutation entries are recorded for fiscal purposes and such entries in themselves are not the evidence of title or entitlement of the parties, in relation to the property in question. The revenue entries can be corrected in accordance with determination of the rights of the parties by the Civil Court. It would be open for the petitioner to take recourse to the remedy available in law, after the decision of the Civil Court in respect of entitlement of the petitioners.

With liberty, as aforesaid, the writ petition stands disposed of. ( R. M. BORDE, J. ) vbd
