The grievance of the petitioner is that the petitioner had filed reference under section 18 of the Land Acquisition Act with the authority for referring it to the Civil Court. The same appears to be filed in April, 2013. The reference is not yet referred to the Civil Court as contended by the petitioner.

The learned A.G.P. submits that it appears that the file of the petitioner is misplaced, same is not available and as such further decision could not be taken.

It appears from the endorsement on the copy of the reference placed on record that the petitioner had also paid the court fees.

In the light of that we pass the following order :-

ORDER

(i) In case the file is not found by the respondents in their office within a period of one month from today, the parties shall reconstruct the file.

(ii) The petitioner may supply the necessary documents and copy of the reference filed in the year 2013 to the respondents.

(iii) The respondents shall thereafter process the same and refer it to the civil Court preferably within three months from the date of reconstruction of file.

(iv) With these observations, the Writ Petition is disposed of. No costs.
