PER COURT :- 1.

The learned counsel for the petitioner seeks leave to withdraw this writ petition. Learned counsel submits that, the learned 5th Jr. Civil Judge, S.D. Jalgaon before whom the Municipal Appeal No.31/2014 is pending may be directed to disposal of the appeal as expeditiously as possible in a time bound manner. Learned counsel submits that, in terms of the order passed by this court dated 9.10.2017 petitioner has deposited an amount of Rs.90,000/-(Rs Ninety Thousand) in the aforesaid Municipal Appeal before the Civil Judge S.D. Jalgaon and, accordingly, this Court has granted interim AAA/-

WP 10881.2017.odt protection restraining the respondents from initiating any coercive steps against the petitioner. Learned counsel submits that, since the order dated 9.10.2017 is complied with, said protection may be extended till the disposal of the appeal by the Court below.

Learned counsel appearing for the respondent has no objection if such directions are given to the Court below.

In view of the above, leave granted. Writ Petition is disposed of as withdrawn. The Court below is hereby directed to dispose of the Municipal Appeal No.31/2014, as expeditiously as possible, preferably within a period of Three Months from today and till the disposal of the Municipal Appeal no.31/2014 interim protection as granted by this Court by order dated 9.10.2017 would remain in force. Writ Petition accordingly disposed of. No costs.
