Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0076/2021, registered at Kopargaon Rural Police Station, District Ahmednagar for the offences punishable under Sections 394, 120-B, 412 read with Section 34 of the Indian Penal Code. 2.

On investigation, the charge sheet has been filed. Some of the stolen goods have been recovered. Co-accused has been granted bail. The offence is triable by the Court of Judicial Magistrate, First Class. It will necessarily take time for commencement and conclusion of the trial. It is informed

that, out of five criminal antecedents, the applicant has been acquitted of three. It is not known as to why Section 412 has been invoked. In the facts and circumstances of the case, the Court is inclined to grant the applicant bail. Hence the order :

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released on bail in connection with Crime No.0076/2021, registered at Kopargaon Rural Police Station, District Ahmednagar for the offences punishable under Sections 394, 120-B, 412 read with Section 34 of the Indian Penal Code on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount.

(iii) The applicant shall attend the concerned police station on every Sunday between 11.00 a.m. to 12.00 noon until next 12 months.

(iv) The applicant shall not tamper with the prosecution evidence.
