In view thereof, Criminal Revision Application is allowed. The offence is compounded. The judgment and order passed by the Adhoc Additional Sessions Judge-4, Jalna in Criminal Appeal No. 61 of 2012 on 06/05/2015 and conviction awarded by learned Chief Judicial Magistrate, Jalna in Summary Trial Case No. 12 of 2010 on 30/07/2012 is quashed and set aside. The applicant is acquitted for the offence punishable under Section 138 of the Negotiable Instruments Act.

The amount deposited by the present applicant in the lower appellate Court, to which respondent No. 2 will be entitled for withdrawal of the same.
