The petitioners/Trusts-Societies which run Child Care Homes under the Juvenile Justice (Care and Protection of Children) Act, 2000 are seeking renewal of the licence and/or re-registration pursuant to the provisions of Section 41 of the Juvenile Justice (Care and Protection of Children) Act, 2015. Their proposals/applications are pending with the respondent No. 2 (Exhibit 'D') dated 18.09.2019. Considering all the 1/2
995 WP 9958 23.odt aspects we have elaborately laid down the directions to be followed by the respondents in similar set of facts in the matter of Mother Teresa Balakashram Vs. The State of Maharashtra and others in Writ Petition No. 7821/2021 and connected matters decided on 08.09.2022. 3.
We dispose of the Writ Petitions by directing the respondents to consider the petitioners applications/proposals for re-registration in accordance with law and in tune with our observations in the matters of Mother Teresa Balakashram (supra) by granting opportunity to the petitioners of being heard and if necessary of making necessary compliances if and when the shortcomings are noticed. The decision shall be taken as expeditiously as possible and in any case within 12 weeks from today. 4.
The petitioners shall appear before the respondent No. 2 on 28.08.2023.
