Learned AGP, on instructions, makes statement that the Revenue Minister would take up the hearing of the urgent relief Application and pass order thereon within a period of four weeks from today.

The statement is accepted as undertaking.

It is complained that the Revision Petition was filed before the Hon'ble Revenue Minister, Mantralaya, Mumbai in April, 2025 and till date the interim relief Application is not heard. At the same time, the contesting Respondents have reasonable grievance about they being not entitled to receive the fruits of the decree. Application within a period of four weeks will strike a balance between the rights of both sides, hence, following order:-

ORDER

(i) The Civil Application is disposed of.

(ii) The Hon'ble Minister (Revenue) to decide the interim/ urgent Application within a period of four weeks from today. (iii) For the four weeks, the possession be not handed over. (iv) It is clarified that the above order of withholding possession has not been passed by this Court on merit and it is only to enable Applicant to seek relief, if entitled from the Minister. The Revenue Minister not to get influenced by the withholding of the possession by this Court for a period of four weeks and to take decision on merits, as per law. v) Parties to act upon authenticated copy this order. 4.
