Applicant seeks bail in Crime No. 0302/2024 registered with Satara Police Station, Dist. Aurangabad for the offences punishable under Sections 109, 118(1), 115(2), 189(2), 191(2), 191(3), 190, 352, 351(2), 351(3), 3(5) of the Bharatiya Nyay Sanhita. 3.

It is an incident happened on the road. Suddenly, Applicant and co-accused started abusing the injured. One of the co-

- 2 - accused stabbed the injured, who was under treatment for a long time. The allegations against the Applicant were that he assaulted one of the companion of the injured with iron bracelet. However, there was no medical evidence to support the allegation. There are no antecedents to the discredit of the Applicant. Nothing is to be recovered from him. A statement is made that injured has been discharged from the hospital. In the circumstances, Applicant deserves bail. Hence, the following order :-

ORDER

(i) Bail Application is allowed.

(ii) Applicant Kamlesh Krushna Dabhade be released on furnishing P.B. and S.B. of Rs. 50,000/- (Rs. Fifty Thousand only) with one solvent surety of the like amount, in connection with Crime No. 0302/2024 for the above offences, on following conditions :

(a) He shall not tamper with the prosecution witnesses.

- 3 - (b) He shall attend the police station and and when called by the Investigating Officer on written notice till filing of the charge-sheet.
