Heard learned counsel for the Applicant and learned APP for the State.

Applicant seeks bail in Crime No. 0034/2024, registered with Waluj Police Station, District Aurangabad for the offences punishable under Section 5 of the Medical Termination of Pregnancy Act and under Sections 3-A, 23 and 25 of the PC and PNDT Act. 3.

Allegation levelled against the Applicant is that he was supplying MPT Kit to the main accused. Allegations are also levelled

- 2 - against him that he is a Medical Practitioner. No MTP kits as such were recovered from him.

Learned APP submits that the MTP kits and medicines used for illegal termination of pregnancy were manufactured in the State of Uttarakhand. That investigation is in progress. 5.

The Applicant has been arrested long back. The Investigating Officer is not sure of the time he would take to identify the genuineness of the Kits. There are no antecedents against the Applicant. The Applicant has the roots at Jalgaon though he is residing in the State of Gujrat. Considering the role attributed to him and progress in investigation, the Court is of the view that his detention would serve no purpose. Hence, the following order :-

ORDER

(i) Bail Application is allowed.

(ii) Applicant Rohit Uttamrao Patil be released on furnishing P.B. and S.B. of Rs. 50,000/-(Rs. Fifty Thousand only) with one solvent surety of the like amount in connection with Crime No. 0034/2024 for the above offences, on following conditions :

- 3 - (a) He shall not tamper with the prosecution witnesses.

(b) He shall attend the trial on each and every effective date.
