After hearing for both sides it appears that learned Trial Court has not rejected the application for bail on merits, however the same came to be rejected on apprehension about likelihood of pressurizing to relevant witnesses, remained to be examined. Learned counsel for the informant states that there are about three more witnesses to be examined in connection with three incidents in question. If it is so, liberty can be given to the applicant to file fresh application before Trial Court. If said application is filed, Trial Court to decide the same on its own merits. Appeal is disposed of accordingly.

Fees of learned counsel Mr. Z. H. Farooqui, who is appointed to represent the cause of respondent no.2, is quantified at 1/2

Rs.10,000/- to be paid by the High Court Legal Services Sub Committee, Aurangabad.
