The learned advocate for the petitioner has strenuously criticized the impugned order and has drawn my attention to the grounds formulated in the memo of the petition.

The learned AGP points out that earlier the parties were before the Honourable Minister under the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 with the proceeding under Section 44(4). By the order of the Honourable Minister dated 28.09.2018, the proceedings were remanded to the District Collector, Hingoli. The impugned order is delivered by the District Collector, Hingoli on 19.07.2019 and the petitioner has a statutory remedy of approaching the Honourable Minister.

*2* 916wp12249o19 In view of the above, this Writ Petition is disposed off with liberty to the petitioner to approach the Honourable Minister within six weeks from today. The time spent by the petitioner in this Court from 05.08.2019 until six weeks from today, shall be a ground for condonation of delay, if any.

Needless to state, after the proceedings are commenced before the Honourable Minister, the same shall be concluded within four months from the date of the filing of the proceedings. kps (RAVINDRA V. GHUGE, J.)
