1) The application is filed for condonation of delay of 17 days caused in filing review application. The applicant was the appellant of Second Appeal No.128 of 2016. It is dismissed by this Court. The suit filed by the sisters of the applicant for the relief of partition is decreed in her favour and that decree is confirmed by the first appellate Court. The second appeal is dismissed by this Court.
2) The grounds mentioned in the application are already considered and dealt with by this Court. Other
2 CA 11706 of 2016 contentions made and the submissions made are not within the scope of review application. Learned counsel then submitted that there should be equitable partition. In any case the authority is expected to see that the partition is equitable. In view of these circumstances this Court holds that it is not necessary to issue even notice in the application for condonation of delay. Nothing can be achieved by entertaining the review application. So the application for condonation of delay stands rejected. Sd/- (T.V. NALAWADE, J.) rsl
