The applicant / wife prays for transferring HMP No. 168/2019 from the Court of the learned Civil Judge Senior Division, Pandharpur to the Court of the learned Civil Judge Senior Division, Beed.

I have considered the submissions of the learned Advocates for the respective sides. I have perused the petition paper book and the reply filed by the respondent. 3.

In an earlier proceeding MCA No.109/2018, this Court had passed an order dated 20/03/2019 transferring the

proceedings filed by the husband from Pandharpur to Beed. 4.

Today, the learned Advocate for the respondent offered to save the marriage by requesting the applicant / wife to come back to the marital home. The learned Advocate for the applicant has taken instructions from the briefing Advocate and informs, after a pass over, that the applicant is not willing to go back to the marital home and she does not intend to cohabit with the respondent / husband.

Notwithstanding the above, since one proceeding has already been transferred to Beed, it would be in the interest of both the parties to transfer HMP No. 168/2019 to the competent Court at Beed so that the husband can attend the proceedings at Beed on common dates in his common visits. 6.

In view of the above, this application is allowed. HMP No. 168/2019 shall stand transferred to the Court of the learned Civil Judge Senior Division, Beed.

Since one proceeding under the Protection of Women

from Domestic Violence Act, 2005 and one proceeding under Section 498-A with connected Sections of the Indian Penal Code, are also pending at Beed, these litigating sides would appear in the transferred HMP on 19/10/2019. Formal notices need not be issued. The husband is at liberty to request the Courts at Beed to grant common dates in his matters so as to enable him to attend all the proceedings in his common visits.
