Heard learned counsel for the applicants, learned AGP and learned counsel appearing for the acquiring body. 2.

By the present application, the applicants pray for permission to withdraw the entire amount of compensation alongwith interest accrued thereon.

Needless to say that non applicant No.1- State had filed First Appeal No.1891 of 2017 challenging the judgment and award dated 23.01.2014 passed by the learned Principal District Judge, Beed in LAR No. 381 of 2009. On 25.03.2025, this Court passed order and disposed of the First Appeal in the light of the Government Resolution dated 03.11.2026 and Corrigendum dated 23.02.2017. During pendency of the appeal, the Non applicant No.1 State deposited the total compensation of Rs.47,85,071/- and the applicants were permitted to

4ca10672-25 withdraw the the amount of Rs.30,00,000/-. Therefore, the remaining amount of compensation of Rs.27,85,071/- is lying with this Court. 4.

Since the main appeal itself is disposed of, it will be just and proper to permit the applicant to withdraw the remaining amount of Rs.27,85,071/- with interest accrued thereon. 5.

In view of the above, the application is allowed. The applicants are permitted to withdraw the remaining amount of Rs.27,85,071/- with interest accrued thereon. ( Y. G. KHOBRAGADE, J. ) JPChavan
