The Petitioner had earlier filed Writ Petition No.2332/2009 for seeking directions for appointment with the Respondents No.2 and 3. The said Writ Petition was disposed of by order dated 10 August 2009, observing that the post is not sanctioned and the decision would be taken as per law. Thereafter nothing has transpired for almost 5 years and today the Petitioner has approached this Court on the ground that on 11 March 2024 the

W.P. No.10128/2024 fmp post is sanctioned.

After passage of time of almost 15 years, it is not possible for us to straightaway direct that the Petitioner be appointed on the post which is sanctioned. The post being a public post, will have to be filled in through public participation and following the governing Rules. If the Petitioner is so entitled in law and facts, it is always open to the Petitioner to apply for the said post. His application would be considered on its own merits.
