Learned advocate for the applicants submits that although the applicants are now challenging the order of cognizance passed by the learned Magistrate, the case has already been committed to the Court of Sessions. The charge has not yet been framed. This Court, in Criminal Application No. 2722 of 2024 along with the companion matter decided on 07.03.2025, had quashed the proceedings against the co-accused, and the applicants are similarly situated. The applicants would appear before the learned Additional Sessions Judge, Amalner, District Jalgaon, and would file applications for discharge under Section 227 of the Code of Criminal Procedure. Therefore, he seeks withdrawal of the present applications with liberty to file an application for discharge before the Additional Sessions Judge, Amalner.
