Non compliance of the order dated 05.01.2022 passed by this Court in WP No.3842/2022, is alleged. Having considered the submissions of the learned Advocates for the respective sides, non compliance is apparent.

We could have proceeded to initiate action against the respondents. However, the learned AGP has received a communication dated 04.10.2022 from Smt.Veena More, Under Secretary, State of Maharashtra, copy of which is placed before us. The same is marked as khs/Oct.2022/635

- 2 - "X" for identification. The learned AGP submits that the corrected proposal was received from the Corporation on 03.10.2022 and the same has been forwarded to the competent authority on 04.10.2022. 3.

The learned Advocate for the petitioners submits that some time frame may be granted to respondent No.1 through respondent No.3 to issue the notification u/s 127(2) of the MRTP Act and the petitioner is satisfied.

In view of the above, this petition is disposed off. 5.

We expect respondent Nos. 1 and 3 to ensure that such notification would be issued on or before 15.11.2022, failing which, the conduct of respondent Nos. 1 and 3 would be construed to mean an aggravated contempt.
