Heard the learned counsel for the applicant and learned APP for the respondent-State.

Considering the sale of the year 2003, provisions of Section 39 of the Maharashtra Money Lending (Regulation) Act, 2014 would not attract. The papers reveal that there were no consistent money lending transaction. The applicant has only one transaction of sale that too he sold the property in the year 2017. Considering the investigation papers, the applicant has good case for anticipatory bail. Hence, the following order :

(i) The application is allowed.

(ii) The interim protection granted to the applicant by the order dated 14.09.2022 stands confirmed on the same terms and conditions.
