The application is filed for bail. The previous application filed for bail was rejected on 28/01/2015. In the circumstances, it was necessary for the applicant to show that there has been change in circumstances. 2.

Learned counsel for the applicant submitted that the case has not made progress and as such the applicant is behind bars since many months. He prayed for release of applicant on bail.

Learned A.P.P. has produced report given by

2 Cr.Apln. 4680.2015 the Investigating officer, which is to the effect that the case is fixed for recording the evidence and the evidence will be recorded in between 15/10/2015 and 17/10/2015. The evidence collected shows that there is dying declaration against the present applicant and there is also the material like statements of witnesses, which are consistent with the dying declaration. The applicant has poured kerosene on the person of deceased and he had set her fire due to some previous dispute. 4.

This court has rejected the previous application by holding that there is sufficient evidence against the applicant. This Court holds that there has been no change in the circumstances.
