The transfer of Hindu Marriage Petition No. 80 of 2015 is sought from the Court of Civil Judge, Senior Division, Nandurbar to the Court of Civil Judge, Senior Division, Dhule on the ground that there are threats from the respondent-husband to involve the applicant in false crime.

The prayer is opposed on the ground that three minor children and aged parents are looked

180.16mca (2) after by the respondent-husband, who is businessman.

In my opinion, the prayer of the applicant needs to be rejected, particularly when the respondent is required to take care of minor children and having regard to the distance between Dhule and Nandurbar, on the condition that the respondent-husband shall deposit forthwith amount of Rs.1500/- (Rs.One thousand five hundred only) with the Court at Nandurbar, of which, on each date, on which the applicant shall attend, amount of Rs.750/- be paid. The respondent shall continue to deposit Rs.750/- on each date and the Civil Judge, Senior Division, Nandurbar shall ensure the payment of Rs.750/- towards conveyance charges to the applicant on each date, if she attends the proceedings.
