The grievance of the petitioner is that the proposal is submitted to the Scrutiny Committee for deciding his tribe claim on 20.06.2011 and is not yet decided.

Learned AGP on instructions states that the vigilance has been conducted. However, the petitioner has not filed any reply and the committee would decide it within three months.

The petitioner shall appear before the Committee on 28th November, 2017 and file his reply to the

( 2 ) wp2694.17 Vigilance Cell report. Thereafter, the Committee shall decide it within three months. The petitioner shall cooperate in expeditious disposal of the said proceeding. 4.

Till the validation proceedings are decided, the employer shall not take adverse action against the petitioner only on the ground that validation proceedings are pending. Of course, the employer can take further course of action, depending upon the judgment that would be delivered in the validation proceeding.

The writ petition is disposed of. No costs.
