Heard learned counsel for the petitioner.

By way of present petition, the petitioner assails the order dated 05.02.2020 passed below Exhibit-12 by the learned Civil Judge Senior Division, Latur in Arbitration Regular Darkhast No.281 of 2017, whereby the Executing Court issued recovery warrant against Judgment Debtor No.2. As the order was passed against Judgment Debtor No.2 and despite of service, nobody appeared earlier, therefore, pursuant to the application Exhibit-12, the Executing Court issued recovery warrant against Judgment Debtor No.2. 3.

I do not find any perversity in the order dated 05.02.2020 passed below Exhibit-12 by the learned Civil Judge Senior Division, Latur in Arbitration Regular Darkhast No.281 of 2017.

In view thereof, the petition is dismissed. No order as to cost.
